Parking Rules & RegulationsThe Cover Letter Accompanying the Parking RegulationsDear WETA Community Resident and Homeowner, The enclosed rules and regulations for the parking and operations of motor vehicles within Water's Edge Townhome Community are now in effect and supersede any other rules and regulations pertaining to the parking and operation of motor vehicles within the WETA Community, with the exception of applicable federal, state, county, and/or Montclair Property Owners Association (MPOA) laws or requirements. These rules and regulations have been approved by the Water's Edge Townhome Association (WETA) Board of Directors and are in accordance with the WETA Articles of Incorporation, Declaration and Bylaws; WETA Declaration Covenants, Conditions and Restrictions; and the WETA Bylaws. You will notice that parking signs are installed at the entrances to our three streets (Spring Branch Blvd, Inlet Place, and Streamside Court) warning that towing will be enforced. If a violation of these regulations occurs, residents are urged to follow the enforcement procedures specified within these regulations. ALL VEHICLES WILL BE TOWED AND STORED AT THE OWNER'S RISK AND EXPENSE! WETA is currently under agreement with the following establishment for towing.
Please contact them for towing and retrieval of vehicles, as well as for information regarding their services. If you have any questions, please leave a message at 703-580-5554 and a WETA board member will return your call as soon as possible. Board of Directors WETA'S Parking Rules and RegulationsS1. PARKING AND OPERATION OF MOTOR VEHICLES S1.1 OWNER/RESIDENT PARKING SPACES a. As stated in Article VIII, Section 2 of the Water's Edge Declaration of Covenants, Conditions and Restrictions for the Water's Edge Townhome Community, each townhome is allocated exactly (two) parking spaces. These parking spaces are marked with the specific address of the townhome and owners/residents of the townhome are entitled to access to and egress from their marked spots. b. Owners/residents, any guests, or any visitors are prohibited from parking in the marked space of another owner/resident without prior permission of the respective townhome owner/resident. c. Vehicles must be parked within the lines provided with each marked space and cannot obstruct any part of the sidewalk. d. As defined under Article 6, Section 6.1 (o) of MPOA Articles of Incorporation, Declaration and Bylaws, (as of March 31, 1990), no boats, buses, campers, trailers, trucks, recreational vehicles, or other large vehicles shall be parked or stored in any marked spaces, common streets, or driveways. The attached MPOA parking guidelines are provided as a supplement to these regulations (see Attachment A). Also, parking or storing of inoperable or junk vehicles is also prohibited. The attached excerpt from the MPOA Architectural Review Committee (ARC) Guidelines entitled, "Prohibition of Inoperable, Unlicensed, and Damaged Vehicles" is prohibited as a supplement to these regulations (see Attachment B). e. Parking is absolutely prohibited on any unpaved common areas, and all paved areas outside of designated parking spaces. f. All individuals are prohibited from parking in such a manner as to inhibit access by privately owned vehicles, emergency vehicles, mail delivery vehicles, etc. This specifically applies to inhibiting access to marked spaces, mailboxes, fire hydrants, etc. S1.2 VISITOR PARKING SPACES a. Parking spaces marked "VISITOR" are only to be used by individuals who do not reside in Water's Edge Townhome Community and only while visiting a resident of Water's Edge Townhome Community. b. Residents are prohibited from parking in spaces marked "VISITOR." c. Any vehicle parked within the community between the hours of 11:00 P.M., and 7:00 A.M. on three (3) occasions within any ten (10) day period will be considered a resident and shall not be allowed to park within a visitor parking without a temporary pass. The enclosed Temporary Pass Application Form shall be filled out and signed by the homeowner or authorized leasee and sent to the WETA Board of Directors or given to a Board member for approval. The WETA Board may take up to three (3) days from the date of receipt to review a temporary pass request. Issuance of temporary passes are subject to approval by the WETA Board. Such a pass shall be displayed in the front window, driver's side and shall be valid for up to fourteen (14) days. d. Residents are responsible for their visitors complying with these parking rules and regulations. S1.3 ENFORCEMENT PROCEDURES FOR PARKING RULES AND REGULATIONS a. When a violation of the MPOA rules and regulations (Article S1.1, Section d) occurs, residents should ontact MPOA Covenants Officer during normal business hours. The MPOA Covenants Officer will enforce these rules and regulations in accordance with MPOA Articles of Incorporation, Declaration, and By-Laws (as of March 31, 1990), Section 6.2. b. Towing with or without cooperation of law enforcement officials, may be instituted in the following violations: 1. Parking in a resident's designated parking space without the occupants permission. 2. Parking in a manner as to block a designated parking space without the resident's permission. 3. Parking on unpaved common areas, because of the destruction and harm to such areas. 4. Parking in areas designated as "NO PARKING" areas such as "Common Driveways" as defined by the WETA Covenants, areas striped with yellow lines (emergency equipment "turn around" areas), areas posted by sign or lettering as "NO PARKING". 5. Parking in any areas that are not specifically identified as parking spaces. 6. Parking in a visitor space in violation of the restrictions set forth in Article S-1.2. The Sequential Abuse Form (enclosed) will be used to document visitor space abuse and shall be provided to a WETA Board of Directors member for action. c. Person(s) authorized to contact the Towing Agent for parking violations are outlined below: 1. For violations of MPOA rules and regulations as outlined in Article S-1.3, Section a, the MPOA Covenants Officer is authorized and will contact the Towing Agent. 2. For all other WETA violations as outlined in Article S-1.3, Section b, Paragraphs 3, 4, 5, and 6, only WETA Board of Directors members are authorized and will contact the Towing Agent. S1.4 CURRENT TOWING FEES AND STIPULATIONS a. Fees charged by the Towing Agent for vehicles removed from WETA property will be the sole responsibility of the owner/operator of the vehicle removed. b. The following fees have been fixed by the current WETA Towing Agreement and is subject to change without notification: 1. Vehicles towed during normal business hours (8:00 a.m. to 5:00 p.m. Monday - Friday; 8:00 a.m. - 2:00 p.m. Saturday and Sunday) shall be charged $65.00 from WETA to the storage lot. 2. Vehicles towed outside normal business hours shall be $75.00 from WETA to storage lot. 3. Vehicles in excess of one ton to include trucks, recreational vehicles, buses, campers, or other large vehicles, and boats or trailers, which are towed may be subject to higher basic tow rates, depending on the size. 4. An additional charge for the release of a vehicle between the hours of 7:01 p.m. and 6:59 a.m., shall be $25.00. 5. Storage charges shall be computed at a rate of $20.00 per calendar day. c. The Towing Agent is responsible for notifying the Prince William County Police Department of all pertinent and required information concerning the vehicle removed from WETA property. d. Signs providing the phone number for the Prince William County Police Department have been posted on the back of the parking restriction signs located on the right side of the entrance at Streamside Court, Inlet Place, and Spring Branch Boulevard. S1.5 OPERATION OF MOTOR VEHICLES WITHIN WATER'S EDGE TOWNHOME COMMUNITY a. Motorized vehicles are to be operated in accordance with existing county, state, and federal regulations. This means that drivers will control and operate their vehicles in a safe and prudent manner. b. The speed limit in Water's Edge Townhome Community is 15 Mph, and is not to be exceeded. Attachment AVehicle Rules and RegulationsI. Registration A. Each resident shall register with Montclair Property Owners Association (MPOA) all vehicles kept by him or her on a regular basis within Montclair and shall affix such decal as may be issued by MPOA on those vehicles in accordance with such instructions as may be issued by the General Manager of MPOA. B. All other vehicles parked with Montclair shall obtain a temporary parking permit from MPOA and display the same as directed by the General Manager unless exempted from this requirement by paragraph I.C. or I.D. below. C. No permit shall be required for non-commercial passenger vehicles kept within for a period of less than thirty (30) days. D. No permit shall be required for commercial delivery or service vehicles delivering to or furnishing services to a lot or living unit within Montclair, provided that the vehicle is not parked within Montclair for more than ten (10) hours in any twenty-four (24) hour period. E. The owner or any other commercial service or delivery vehicles delivering to or furnishing services to any lot or living unit shall obtain a temporary parking permit from MPOA and shall display the same on the vehicle in accordance with the instructions of the General Manger of MPOA. All vehicles owned by those engaged in the development of or construction upon any property within Montclair shall be subject to the requirements of this paragraph E. II. Restrictions A. No vehicle shall be parked on the common areas of Montclair unless it displays a decal or parking permit, or is exempt from displaying a decal or parking permit under this regulation. Any vehicle parked in violation of this paragraph shall be subject to towing, without notice, at the risk and expense of the vehicle's owner. B. No vehicle shall be parked on common areas in such a manner as to obstruct other parking spaces. No vehicle shall park on common areas in such a manner as to block one or more vehicles, occupy more than one space, park in a posted fire lane, parked on lawn and grassy areas, sidewalk, walkway or patio area, or park in designated handicapped parking spaces without authorization. Any vehicle in violation of the provisions of this paragraph shall be subject to towing at the risk and expense of the vehicle's owner, without notice. C. Except for trucks referred to in paragraph I.D. or I.E. above, no truck shall be parked on any common area, street, lot or building site, except within a garage or screened in area approved by the appropriate MPOA committee such that it is not visible from adjacent properties or roadways. D. No vehicle shall be parked on any street after an accumulation of snow of two inches or more in a twenty-four (24) hour period until the snow has been removed. E. No vehicle shall be parked on any street in such a manner as to impede access to any common area or lot or in violation of state law or county ordinance. III. Definition (1) any vehicle with commercial lettering; (2) any vehicle with roof or side racks designed to hold ladders or other construction apparatus, irrespective of whether such apparatus is present; (3) any vehicle which uses wood, metal, or other materials to extend the height of the sides or to increase cargo capacity; and, (4) any vehicle which has as its primary purpose the towing of other vehicles, the removal of snow, or which clearly is not intended to be used for personal transportation purposes. Nothing in this resolution shall be construed to hold MPOA, its Board of Directors, employees or agents responsible for damage to vehicles or loss of property from vehicles parked on the common area or toward therefrom. ATTACHMENT BProhibition of Inoperable, Unlicensed and Damaged Vehicles1. General For purpose of these guidelines, the following definitions apply: a. Inoperable Vehicle - Any vehicle that is missing a major component necessary for normal or functional operation. b. Unlicensed Vehicle - Any vehicle that does not have a valid license plate, county sticker or inspection sticker. c. Damaged Vehicle - Any vehicle which is characterized by one or more of the following deficiencies: unsightly body damage; severe rust; primer paint covering over one fourth (1/4) of the vehicle body; severely dented or crumpled components; missing parts and flat or missing tires. 2. Specific Provisions a. Inoperable, unlicensed or damaged vehicles shall not be permitted or stored visibly on any property or street (public or private) within Montclair. They are subject to towing at the owner's expense. b. Vehicles may not be constructed, reconstructed, repaired or kept on jacks, jack stands or other forms of lifts visible on any property or street (public or private). c. Emergency repairs will be permitted if performed within twenty-four (24) hours. d. No vehicle shall be permitted to be parked on lawns or grassy areas. |
